Srinagar Court issues direction for attachment of Al-Mehmood MD’s properties

Srinagar, July 13: Srinagar Court has issued directions to the concerned Tehsildar for attachment of property of Sikander Khurshid Managing Director of Al-Mehmood Builders, after he failed to pay the amount to an aggrieved as per court directions.

After hearing parties in the cheque bounce case, the Court of Judge Small Causes Srinagar presided over by Tabasum, observed that Appellate Court of 4th Additional Sessions Judge, Srinagar has disposed of the conviction appeal with the direction to this court to recover the lump sum amount of Rs. 20 lakh from accused person.

The applicant Fehmeeda Jan was represented by Advocate Aamir Masoodi.

Court further observed that out of Rs 20 lakh, accused Sikander Khurshid of Rawalpora Srinagar had paid Rs 4 lakh in trial court.

“The amount of 16 lakh was to be paid in equal four installments and the period gap of each installment must not be more than one month. The accused person has not complied with the order passed by the Court of 4th Additional Judge, Srinagar,” Court observed.

“I deem it fit and proper to direct the office to issue warrant of attachment in the name of Tehsildar concerned who is directed to attach movable as well as immovable property belonging to the non-applicant namely Sikander Khursheed in case the he fails to pay an amount of Rs. 16 lakh within a period of one month,” Court said.

It added that Tehsildar concerned is authorized to sell the movable as well as immovable property or so much thereof as shall be sufficient to satisfy the sum.
