Srinagar Court asks SSP Ramban why legal action be not initiated against him for non-execution of warrants

Srinagar, Feb 13: Srinagar Court has asked Senior Superintendent of
Police (SSP) Ramban as to why proceedings under law may not be
initiated against him, for not having executed the warrants against
the accused in cheque bounce case.
After hearing Complainant Ali Muhammad Sumji through his counsel
advocate Aamir Masoodi, the Court of Forest Magistrate Srinagar
presided over by Feroz Ahmad Khan observed that Ramban Police have not
executed the warrant against the accused and have not filed any
report thereof.
“I deem it proper to issue show cause notice to
Superintendent of Police Ramban as to why proceedings under law may
not be initiated against him, for not having executed the warrants
against the accused and have not filed any report thereof,” the court
said.
It added that non-bailable warrants issued earlier by court are
recalled with the direction to registry to issue fresh non-bailable
warrant of arrest forwarding the same to SSP Ramban for its early
execution and return, without any fail.
Court said that it is expected from the Senior Officer of the Police
that the warrants are duly executed and the report submitted to this
court, directing registry is directed to forward the copy of this
order to SSP Ramban by way of registered post along with the fresh
non-bailable warrant of arrest against the accused.
Court further observed that the instant complaint has been filed on 4
December 2021 and on the same day notice was issued to the accused, to
be served through SSP Ramban.
“However, perusal of the proceedings reveals that time and again
non-bailable warrants of arrest have been issued against the accused
to be executed by SSP Police Ramban. From the record it further
transpires that the SSP Ramban has been directed to execute the
warrants against the accused by sending warrants through electronic
mode by way of email dated 12 August 2022 at 3.59 p.m”.
“It appears that despite due services of notice and warrants from time
to time against the accused person, police concerned has not
discharged their duties, by executing the warrants of this court. The
police have not even bothered to return the warrants
unexecuted with some report. Without commenting further on the
laxity shown by the police in executing the warrants against the
accused person from the last two years.”
