DSP Lynching case; Srinagar Court admits one of the accused to bail

Srinagar, April 11: The trial Court in Srinagar Monday granted a bail to one of the accused persons in Deputy Superintendent of Police (DSP) lynching case 2017.

DSP Muhammad Ayub Pandit was lynched at Nowhatta Downtown Srinagar on 22 June 2017.

 

After hearing prosecution and defence counsel, the Court of Additional Sessions Judge/ TADA/ POTA Srinagar presided over by Manjeet Singh Manhas admitted the accused Moin Ahmad Matoo to bail.

In its order addressed to Kot Bhalwal Jammu authorities, the court said that the accused person has been admitted to bail on furnishing bail bonds with two sureties to the tune of Rs. 2 lakh and same has been furnished accepted and attested by this court.

“You (Kot Bhalwal Jammu authorities) are as such directed to release the accused (Moin Ahmad Matoo) from the custody after obtaining personal bonds in the like amount provided that he is not involved in any other case or offences,” the court said.

The court imposed several conditions on the accused which include that the accused person shall appear before the Investigating Officer (IO) and cooperate with IO as and when directed.

“Accused person shall not induce witnesses or the prosecution directly or indirectly and shall not tamper with the evidence of the prosecution,” the court said in its conditions imposed on the accused.

It further said that the accused person shall not commit similar offences in near future and he shall not leave the J&K without seeking prior permission of the court and will not change his residence during the such period.

Twenty one persons including four juveniles are facing trial in DSP Muhammad Ayub Pandit lynching case.

Pandit was lynched at Nowhatta Downtown Srinagar during the holy night of Shab-e-Qadr — on 22 June 2017.

After completing investigations, Police filed a charge sheet in the Srinagar court against 17 persons accused on 7 October 2017. It also filed a separate challan against four juveniles in the case.

 

 

Prosecution has listed 84 witnesses in the case.
