Pulwama Court Sentences Two Accused to Life Imprisonment for 2011 Murder
Srinagar, Aug 24 : The Principal Sessions Judge has sentenced two men to life imprisonment for their role in a 2011 murder case. Younis Ahmad Dar and Javaid Ahmad Bhat were convicted under sections 302, 364, 387, and 120-B of the RPC.
The case was represented by Special Public Prosecutor Mr. Gh. Mohi-ud-Din Dar, Advocate for the State. Mr. Gazanfar Ali Advocate represented accused No. 2, while M/s. Gull Mohammad Advocate and Associates represented accused No. 3 to 5.
The convicts were sentenced to imprisonment for life under Section 302 RPC. They were also sentenced to 7 years rigorous imprisonment for abduction under section 364 RPC and 5 years simple imprisonment for extortion under section 387 RPC. All sentences will run concurrently.
The court ordered the Member Secretary, J&K Legal Services Authority, to release a compensation of Rs. 3 lakhs to the parents of the deceased under the Victim Compensation Scheme, 2013.
The occurrence took place on October 28, 2011. The convicts have been behind bars for over 12 years. The court stated that the convicts cannot be compelled to pay fine or compensation to the victim due to their prolonged incarceration.
The necessary warrant of committal will be sent to the Superintendent Central Jail Srinagar for lodging the convicts and receiving the sentence subject to confirmation by the High Court.
The entire record will be submitted to the High Court for confirmation of the sentence of life imprisonment awarded to the convicts. The convicts have been informed about their right to prefer an appeal.
A copy of the order of sentence will be furnished to the convicts free of cost. A copy of the order of sentence will also be forwarded to the Member Secretary, J&K Legal Services Authority, for the release of compensation to the parents of the deceased.
The judgement of conviction and order of sentence will be forwarded to the Deputy Commissioner and Sr. SP Concerned for information.
