Pulwama Court convicts two persons for murder, arguments on quantum of punishment on Thursday

Srinagar, Aug 17: Pulwama Court on Saturday convicted two persons in a murder case of 2011.
After hearing prosecution and defence counsel, the court of Principal Sessions Judge, Pulwama, presided over by Naseer Ahmad Dar, said that prosecution has proved the guilt of accused beyond reasonable doubt.
While refering to various Supreme Court judgements and provisions of law, the court said the prosecution has established the guilt of murder, abduction, and extortion.
The court held that the prosecution successfully established the guilt of Younis Ahmad Dar and Javaid Ahmad Bhat beyond any reasonable doubt.
The evidence presented, including confessional statements, the recovery of the deceased’s body, and corroborative scientific evidence, linked the two men to the crime.
The court said that the conspiracy to kill the victim was hatched and executed by the accused on the day of the incident.
The murder, according to the prosecution, was carried out by strangulation, and any possibility of death by drowning was ruled out by medical evidence.
The court observed that the extortion money demanded by the convicted individuals was proven during the trial.
However, the court acquitted two other accused, finding no conclusive evidence against them.
The judgment also directed that one of the acquitted individuals, who was out on bail, be relieved of all bonds, while the other should be set free unless involved in another case.
The judgment was pronounced in the presence of the convicted individuals via video conferencing from Central Jail Srinagar, while the acquitted woman was physically present in court.
The court has scheduled the hearing on the quantum of punishment for August 22, this year.
Court added that the case will continue against an absconding accused in the case and will be put to trial once apprehended
