Man Accused Of Uploading Morphed Pictures Of Woman Denied Bail Sub Judge Baramulla Ruled That The Accused Faced Grave Offences

Baramulla, Jan 24: Special Mobile Magistrate, Sub Judge Baramulla, Parveen Pandoh today rejected the bail plea of an applicant challenging the FIR lodged at police post Delina – FIR No 2010 of 2018 – under Section 294 of the RPC and Section 67 of the IT Act. The applicant is accused of uploading morphed pictures of a woman on social media.

His counsel had filed an application for the grant of bail on the grounds that the accused is innocent, has no criminal background and has never indulged in any criminal activity directly or indirectly. The counsel further argued that the police have registered a false and fictitious case against the accused.

“The applicant hails from respectable family and owns huge movable and immovable property,” the counsel said. “His kith and kin also reside in the state so there is no apprehension of his jumping bail. The applicant is not keeping good health and is ailing.”

The complainant submitted that she lost her mobile phone on 29.12.2018. She then received a call from the accused, who claimed to have her phone. He started blackmailing her by obtaining photographs from her phone and uploading them to Facebook after editing them in a salacious manner, she alleged.

Following the complainant’s submission, the prosecution opposed the bail plea of the accused, arguing that he was charged with non-bailable offences under Section 294 of the RPC and Section 67 of the IT Act. The prosecution further submitted that the material evidence collected by the police during its investigation prima facie indicates that the accused is guilty.

Given the gravity of the offences allegedly committed by the accused, the Sub Judge Parveen Pandoh observed that he was not entitled to bail at this stage, and dismissed the application. (CNS)
