Fast Track Court in Jammu convicts two persons in kidnapping, rape case of class 10 student

Srinagar, May 23: A Fast Track Court in Jammu found two persons guilty for kidnapping of a minor girl and committing rape of class 10 student in 2014.

The court will hear arguments on the quantum of punishment on Tuesday (24 May).

After hearing prosecution and defence counsel, the Fast Track Court Jammu presided over by Khalil Choudhary said that the evidence on record “unerringly point towards the guilt of the accused”.

The Court observed that the 15-year-old student was forcefully kidnapped by Gharu Ram alias Bittu along with another person Sunil Kumar alias Kokar in the Red colour Maruti Car.

Court further observed that the Police recovered the girl from a jungle area while police later arrested the accused.

While referring to various Supreme Court and High Court judgements, the court said that the evidence on record “unerringly point towards the guilt of the accused”.

“There is a complete chain of events to indicate that within all human probability the crime was committed by the accused and all the circumstances brought on record and established are consistent with the guilt of the accused and inconsistent with his innocence,” the court said while referring to various provisions of law.

“The accused persons Gharu Ram alias Bittu squarely liable for the commission of house trespass, rape and kidnapping of the minor girl and convicted for the offences under section 376(1)/363/452 RPC,” the court said.

The Court found another accused Sunil Kumar alias Kokar guilty for abetment for the kidnapping of the minor girl.

The court listed the case for Tuesday to hear the arguments on quantum of punishment.
