Budgam Court Issues Non-Bailable Warrant Against Hizbul Mujahideen Supremo Syed Salahuddin

 

Budgam: A Special Judge designated under the NIA Act in Budgam has issued a non-bailable warrant against Mohammad Yousuf Shah alias Syed Salahuddin, the supreme commander of Hizbul Mujahideen, in connection with FIR No. 331/2012 registered at Police Station Budgam.

 

 

 

 

The order was passed after the prosecution, represented by the Additional Public Prosecutor, sought issuance of a non-bailable warrant under Section 73 of the Criminal Procedure Code, citing that the accused is evading arrest and is currently residing in Pakistan after crossing the border.

 

 

 

According to the court record, the accused has been booked under Sections 13, 18, 20, and 39 of the Unlawful Activities Prevention Act (UAPA), 1967, along with Section 506 of the RPC. Police authorities, including the SHO Police Station Budgam and the In-charge Police Post Soibugh, submitted certificates confirming that the accused could not be traced in India and had infiltrated into Pakistan.

 

 

 

 

After perusing the case diary, the court observed that sufficient prima facie evidence exists linking the accused to the alleged offences. The court also noted that the investigation material has been forwarded to the competent authority for sanction, paving the way for filing of the charge sheet and trial in absentia.

 

 

 

 

Taking note of the accused deliberately evading the process of law, the court ordered Jammu and Kashmir Police to execute the non-bailable warrant and arrest the accused in connection with the said case.
