4 Terror Accused Involved In Waging War Against India, charge-sheeted

Court to record evidence against ‘absconding Khashif’ in absence

Srinagar, March 4: The State Investigation Agency (SIA) on Saturday filed a chargesheet against four Jaish-e-Mohammad (JeM) terrorists, who,  as per chargesheet, were involved in waging war against the Government of India.

The chargesheet was produced before the Special Court in Srinagar established under NIA Act. Court would Court to record evidence against ‘absconding Khashif’ in his absence as accused person is absconding, and that there is no immediate prospect of arresting him.

As per chargesheet, the terror accused Umar Mushtaq Khan of Begum Bagh Kakapora Pulwama, Murtaza Rashid Dar of Samboora Pulwama, Sajjad Ahmad Dar of Dethoo Herpora Shangus Anantnag, and Ali Kashif Jan of Khyber Pakhtunwa, Pakistan of Jaish-e-Mohammad are involved in terrorist activities.

A Police official privy to investigation told ANN News that a case was registered on 1 September 2022 at Police Station CIK (SIA) Kashmir based on credible inputs that handlers of terrorist and secessionist organizations operating across the border have hatched a criminal conspiracy with members of prescribed terrorist organizations operating in UT of J&K have created new modules of OGWs for waging war against country.

He added that these modules of OGWs under a conspiracy have been created not only for providing variety of support to terrorist organization but also to fight a proxy war in J&K with a larger objective of secession.

“During investigation, it was established that these modules of OGWs are operating in secrecy with adversaries and operate independent of each other. The modules are in constant and continuous touch with handlers of terrorist organizations across the border in Pakistan,” he said.

As per chargesheet, amongst other modes of communication it was learnt that encrypted internet messaging platforms, besides other software applications were being used.

“The accused were found having clandestine connections with Pakistan based terrorist Ali Kashif Jan @ Ali Kashif of prescribed terrorist outfit JeM through social media and other secret messaging apps working with a motive to promote terrorist activities, besides procuring arms and ammunition and distributing them among the terrorists for carrying out terrorist activities and waging war against India,” it reads.    

The chargesheet has been filed against accused including one entity based in Pakistan against whom proceedings under section 299 of Code of Criminal Procedure have been initiated.
